These Terms of Service (“Terms”) govern your access to and use of bomlan.net and any content, features, or materials made available through it (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1) Who we are; what this Site is

Bomlan (“we,” “us,” “our”) operates a personal portfolio Site showcasing design and development work and related information. The Site does not provide user registration, accounts, or online purchases.

2) Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Site.

3) Acceptable Use

You agree not to:

• Violate any applicable law or regulation.
• Copy, reproduce, distribute, publicly display, or create derivative works from the Site’s content except as expressly permitted in these Terms.
• Use any automated means (e.g., bots, scrapers) to access the Site without our prior written permission.
• Interfere with or disrupt the Site’s operation or security (e.g., probing, scanning, or testing vulnerabilities).
• Upload or transmit any malicious code, spam, or content that infringes others’ rights.

We may suspend or restrict access if we believe you have violated these Terms or pose a risk to the Site or others.

4) Intellectual Property

All content on the Site—including text, graphics, logos, images, code, and design—is owned by us or our licensors and is protected by copyright and other laws.
You may view pages and share links for personal, non-commercial purposes. Any other use requires our prior written permission.

Client logos, trademarks, and third-party assets displayed on the Site are the property of their respective owners and are used for identification or portfolio purposes only.

5) Portfolio Materials & Credits

Portfolio items may include work performed for clients, agencies, or collaborators. Inclusion of such materials does not grant you any license or rights in those materials. Any credits or attributions provided are for transparency only.

6) Feedback & Submissions (via contact forms)

If you submit ideas, feedback, or other materials through the Site’s contact forms (collectively, “Submissions”), you represent that you have the right to share them and that they do not infringe any third-party rights.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and communicate your Submissions solely to review and respond to your inquiry and to operate and improve the Site.
Do not send confidential or proprietary information through the contact form; we assume no confidentiality obligation for unsolicited Submissions.

7) Privacy

Our collection and use of personal information (e.g., full name and email from forms; usage data via Google Analytics) are described in our Privacy Policy available on the Site. By using the Site, you acknowledge that processing.

8) Third-Party Services & Links

The Site may use or link to third-party services (e.g., Google Analytics) and external websites. We do not control or endorse third-party content, and your use of those services/websites is at your own risk and subject to their terms and policies.

9) Informational Content; No Professional Advice

Content on the Site is for general informational and portfolio purposes only and does not constitute professional advice. You should not rely on it as a substitute for professional judgment.

10) Disclaimer of Warranties

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

11) Limitation of Liability

To the fullest extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Site, even if advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to the Site shall not exceed USD $100 (or the equivalent in local currency).

12) Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your Submissions; or (c) your violation of these Terms or applicable law.

13) Changes to the Site and to these Terms

We may modify the Site or these Terms at any time. When we do, we will update the Effective date above and post the revised Terms on this page. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

14) Termination

We may suspend or terminate access to the Site at any time, with or without notice, for any reason or no reason. Sections that, by their nature, should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability) will survive.

15) Governing Law; Venue

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of courts located in the Philippines to resolve any dispute arising from or relating to the Site or these Terms.

16) Electronic Communications; Notices

By contacting us or using the Site, you consent to receive communications from us electronically. We may provide notices by posting on the Site or by emailing you at an address you provide.
Legal notices and claims (including IP notices) should be sent to hello@bomlan.net with the subject line “Legal Notice”.

17) Copyright Complaints

If you believe content on the Site infringes your copyright, please email hello@bomlan.net and include: (a) identification of the copyrighted work; (b) the allegedly infringing material and its location on the Site; (c) your contact details; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act on the owner’s behalf.

18) Miscellaneous

• Severability: If any provision is found unenforceable, the remaining provisions will remain in full force.
• No waiver: Our failure to enforce any right is not a waiver of future enforcement.
• Assignment: You may not assign these Terms without our prior written consent. We may assign them as part of a reorganization, merger, or asset transfer.
• Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Site and supersede prior or contemporaneous understandings.
